Constitutional Court (MK) rejects entire PHPU lawsuits filed by three parties, Democratic Party, People’s Coscience Party (Hanura), and Greater Indonesia Movement (Gerindra) for Bali Province, as being recited by Head of MK Hamdan Zoelva on Wednesday (25/6) at MK Plenary Room.

On Dems’ pleading, MK inspects Plaintiffs’ arguments over inflated 146 votes and flattened 61 votes which was shown in the margin between voters and valid ballots spread out in 13 TPS in Jimbaran sub-district, Benoa, Ungasan, Tanjung Benoa. It is finally considered to just a matter of insignificant error recap, besides the change was only comprising 7 ballots.  

“Albeit, according to the Court, the margin doesn’t clearly generate as what the Applicant has addressed. This was beared in the evidence which shows less votes possesion,” Deputy Head of MK Arief Hidayat explained.

Bali 5 Electoral Area

In relation to Gerindra’s lawsuit which bears error recap in Bali 5 for DPRD candidates, Mahkamh doubt the evidences was generated by factual events. According to the Court, different way of writing can be found after comparing Applicant’s evidences and the actual C forms, C1 forms, and attached C1 form. Besides, Applicant’s evidences contained various signature as Defendant’s signature.

MK found many of Plaintiif’s evidences (C form, C1 form, and attached C1) have its location information filled blank. The columns (TPS, Sub-district, city, and province) was left unfilled. While Defendant’s evidences flaunt otherwise.

Moreover, MK found several legal facts as I Nengah Rena (Sawan PPK Chief) and Putu Suartana (Seririt PPK Chief) have testified, the recap was conducted properly and no protest was delivered during the recap, all of the witnesses agreed to sign the recap.

“Based on listed facts, according to the Court, evidences and witnesses’ testimonies which were presented by the plaintiffs are unreliable and away from convincing. Therefore, Plaintiff’s argument is not proven,” Aries said

MK also reject all pleadings for Dapil Bali 8 and Dapil Karangasem 5. According to the court, the plaintiffs’ arguments were considered unproven and stood on no legal ground.(Lulu Anjarsari/mh/kun)
